The Patty Roggeveen Conflict Watch Continues.

This just gets screwier and screwier, people.
You will recall back before the Land Bank met in August, Dreamland Executive Director (Who is also the Selectman Chair), Patty Roggeveen announced days earlier that she would be making a proposal to the Land Bank, in which the Land Bank would pay $2.5 million in exchange for a seat on the Dreamland Board and a fraction of an acre of the Dreamland Lot facing the Easy Street Basin so that they could create a pocket park.
$2.5 million dollars is a lot of money. Especially for a piece of property within the historic waterfront area that is subject to Chapter 91 regulations and has to be open to the public anyway.
But I give Patty some credit. She has some major cajones to go to the Land Bank and expect them to pay $2.5 million for essentially the rights to secure a piece of land for the public that the public already has rights to. That would have been a sweet deal. It’s like me selling a part of the common cu de sac to my neighbor for $10,000 — a piece of road that, as a member of our neighborhood, he partially owns already. Cool if you can pull it off.
Fortunately for the people and not so much for Patty, the Land Bank asked their legal counsel, a representative from Deutsch Williams, what they thought in executive session (Where Patty was present) and the Deutsch Williams opinion was that this was not money well spent. And the Land Bank demurred. It’s not in keeping with Land Bank policy to purchase land that is already protected. Fine. All is well, right?
Well not so much.
You see, then Patty Roggeveen, in her capacity as Dreamland Director, was quoted in the I&M saying, “My sense is that they (The Land Bank) are wrong and they’re not getting the right advice from Deutsch Williams, for whatever reason.”
This is not the first time Patty has been critical of Deutsch Williams. She ran for selectman on a platform of reforming legal costs. Her premise all along has been that the town has been overcharged by Deutsch Williams. As a selectman, she, along with Selectman Brian Chadwick and Town Manager Libby Gibson (who has a major grudge against Deutsch Williams partner, Paul DeRensis after he provided a legal opinion a few years back saying that Libby’s husband, Charlie could not be hired as police chief as long as Libby was the Town Administrator/Manager) spearheaded an effort to get a third-party consultant to do an overview of our legal spending. (You can read that by clicking below.) The upshot of the consultants report was that Deutsch Williams was not overcharging. In fact, the report showed that the town is getting a good deal. According to DeRensis, much of the work the firm now does for the town is at below cost due to the intricacies of the retainer situation. The reasons for any historic overages in legal spending, according to the report, are due largely to mismanagement by the town administration. Ouch. Holy Backfire, Batman.
(By the way, the “for whatever reason” added to the end of Patty’s newspaper quote above is a nice, albeit somewhat slimy, touch. It implies that Deutsch Williams may have made their legal determination for a reason other than to provide proper legal counsel to the Land Bank. She’s implying that the legal advice is politically motivated. Which is rather ironic, given what happened next.)
This week, at the BOS meeting, a meeting where Patty had been questioned on her many conflicts by Selectman Whitey Willauer, Patty pushed for a vote to oust Deutsch Williams by asking for a formal RFQ to seek new legal counsel for the town. The vote passed 4-0.
So to recap:
Patty has it out for Deutsch Williams. Deutsch Williams provides a legal opinion to the Land Bank that would deny Patty’s non profit $2.5 million. Patty publicly trashes Deutsch Williams in the newspaper and implies that they are not operating in accordance with their charge as legal counsel. Patty votes to fire Deutsch Williams.
I’m not sure, but I think that matches the textbook definition of a conflict. And a $2.5 million dollar one at that.
Michael Kopko, was sick in the hospital with a fever and a nasty blood infection Wednesday night and was not in attendance. Interestingly, Kopko sent a formal letter to Patty and the Board asking her to seek a determination with the state ethics commission on Patty’s dealings with the Land Ban before Wednesday Night’s vote. And it just keeps getting screwier. YACK on.

Now. May I just say, I have a HECK of a time trying to figure out WHAT in heck is going on on this YACK site now. I only drop in once a month, or so.
SECONDLY: Libby Gibson AND Charlie Gibson are two of the Town's most valuable assets. I cannot imagine why EITHER of them continues to put up with the public (and private) CRAP that is flung in their general direction EXCEPT that they LOVE Nantucket.
I know (for sure) that Libby was raised with the expectation that she would work hard, study hard, and GIVE BACK to The Town that afforded her Family so many good memories, and happy Times.
My family are relative newcomers - we've only been here since 1846 (AND, BTW, we had NOTHING to do with The Fire) - but MY family, for all they've strived to contribute for six generations, hasn't contributed anywhere NEAR what Libby Ranney Gibson's family has.
And, I MEEN it.

2. Unless something changed
Unless something changed since I served on the BOS, Libby always recuses herself whenever the issue of her husband surfaces. If my feeble memory serves, when Charlie was acting Chief, Nancy Oliver stepped in for Libby to avoid real or perceived conflicts. (Hmmm. There's a lesson here for other TON officials.)
I'm surprised at the outright attacks on town counsel. I always assumed Patty's campaign platform was an attempt to appear fiscally conservative. Her continued support of unsustainable fiscal policies that require layoffs, overrides, or cuts in town services prove otherwise.

Grant - your continuing attacks on Patty, the snide comments about Libby Gibson, and the almost unseemly support of Deutsch Williams are getting more than tiresome.

Flint, If I've said anything that is inaccurate or untrue, please fill me in. I want to be 100% accurate and truthful in my blog posts. That goes for any reader. If you don't want to post to the site, feel free to email me privately. If I'm wrong, I want to know it and correct that wrong.
I have not, to my knowledge, made any snide comments about Libby. If you can point any out, I'd be happy to edit them. My goal is to discuss policy and leave politics aside. I like Libby a great deal and think that her service to the town has largely been positive, but there are some instances where her performance has been lacking, and the town, as a result, has suffered. No one is perfect. But for the money she is paid and for the importance of her position to every citizen of this island, I think we should and can expect better. I understand where you are coming from and if my daughter were being criticized publicly, I would come to her defense as well. That's understandable. But I also don't think any public official should be above scrutiny and public discussion. Even if that public official was my own flesh and blood. Or yours.
As for Deutsch Williams, the firm, or rather Paul DeRensis, has given this town 24+ years of service as our legal counsel. That's worth a great deal. You don't just toss that amount of work out with yesterday's fish. Much of the work DW has done has been below their costs. Why? Because Paul DeRensis loves this town and wants to be of service to it. I believe that supporting Paul is not unseemly, it's downright overdue. He is one of the good guys. And anyone who says otherwise will have a quarrel with me.
Thanks for reading. It is feedback like this that I value the most (although I wish you would back up your argument with some detail and reason why you feel I am wrong so we can have an honest discussion about it). At least you have the guts to speak out and say something, and for that you have my respect, despite the fact that we disagree.
Those who remain silent in support of a long list of blatant conflicts, mismanagement, and questionable goings on in order to perpetuate what Matt calls "The Nantucket Way" need to take a long hard look at our future as a community. There is a reason young people and people of integrity largely shy away from public service. Actions like those of Patty Roggeveen cast a black shadow over our town's leadership. This perpetuates, negativity and cynicism and a sense, real or perceived, that you can't fight city hall because the fix is in.
I think this needs to change. I hope I'm not alone.

5. Youth,integrity and PR
If someone strongly feels and can support a complaint to the Ethics Commission regarding Patti Roggeveen, then he, she or they have to move forward in lodging it. Indignity, innuendo,etc. are fine but there is certainly a way to clear the air one way or another.
I'm curious if just asking the questions raised of the Commission is essentially "lodging a complaint"? I really don't know the answer.

As for what's happening with Town Counsel? It's unconscionable. The Board spent around $15K of taxpayer money, at a time we can NOT afford it to pretty much totally ignore the report recommendations and put out to bid a service integral to the function of government when they have Paul DeRensis and Deutsch already in place for neigh onto a quarter century!. I'll cease at this point and probably start another thread. Blog? Well, I'll get something else going on YACK.

OK. As I see it, the "Nantucket 'Way' " consists of anything that someone with a BIGGER mouth than YOU embraces.
Libby & Charlie Gibson owe this town NOTHING! WE owe them.
HOWEVER, I do believe that this town owes Deutsch-Williams (and, specifically Paul DeRensis) a boatload of gratitude, and loyalty.
I have been Town & County Clerk for 12+ years. Paul DeRensis has NEVER steered me wrong in my legal dealings, nor pertinent business on behalf of the Town & County of Nantucket. In point of fact, Paul DeRensis (and his associates) have facilitated legal disputes in FAVOR of the Town, and given me the very best, cutting-edge advice, whenever I've had a question about the correct, and most advantageous course to take as your Clerk.
I don't believe, FOR EVEN A SECOND, that Patty Roggeveen is working to undermine, nor abandon the use of, the Deutsch-Williams firm. Patty has done a sterling job, representing us as Chair of the BOS. I think SOMEONE has their hairs/wires "crossed."

I would be really sad if, indeed, Patty or anyone else, was deliberately trying to oust them/him. Actually, I would be pretty angry.
